1. Acceptance of these terms

By using casasimple.net, submitting a form, starting a chat, or exchanging text messages with Casa Simple, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site or our services.

2. Who may use our services

You must be at least 18 years old and able to form a binding contract. If you consent to receive text messages, you confirm that you are the subscriber of the mobile number you provide, or that you are authorized to give consent for that number.

3. About Casa Simple

Casa Simple is a licensed Florida real estate brokerage. Content on this site is general information about our brokerage and our agent program. It is not legal, tax, or financial advice, and nothing here creates a brokerage relationship. A brokerage relationship is formed only through a signed written agreement.

4. SMS text messaging terms

These terms apply to all text messages sent by or on behalf of Casa Simple, including messages sent by ELLA, our AI assistant.

Our messaging programs

• Agent recruiting and onboarding. If you apply to join Casa Simple or ask us about our agent program, we send messages about your application, next steps, scheduling, and onboarding.
• Client and lead communication. If you inquire about a property or request information, we send messages responding to your inquiry, including property details, appointment scheduling, and transaction updates.

Consent

We send text messages only to people who have opted in. You provide consent by giving us your mobile number and agreeing to receive texts — for example, by checking the consent box on a form, by texting us first, or by asking us to text you. Consent to receive text messages is not a condition of purchasing any property, good, or service.

Message frequency

Message frequency varies and depends on your activity with us — for example, where you are in an application or an active transaction.

Cost

Message and data rates may apply. Casa Simple does not charge for text messages, but your mobile carrier's standard rates apply. Check your plan with your carrier.

How to opt out

Reply STOP to any message at any time to stop receiving texts. You will receive a single confirmation message and then no further messages, unless you opt in again. You may also call us at (305) 564-1290 to be removed.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.

Privacy

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.

5. AI-assisted communications

Some messages are drafted or sent by ELLA, our AI assistant. ELLA may respond automatically to your messages. Information ELLA provides — including property details, availability, and pricing — may be incomplete or out of date and should be confirmed with a licensed agent before you rely on it.

6. Agent applications

Submitting an application does not create an offer, an agreement, or an employment or independent-contractor relationship. We evaluate applications at our discretion and may verify your license status with the Florida Department of Business and Professional Regulation. Compensation terms described on this site are subject to the written agreement you sign if you join.

7. Fair housing and equal opportunity

Casa Simple complies with the federal Fair Housing Act, the Florida Fair Housing Act, and all applicable equal opportunity laws. We do not discriminate on the basis of race, color, religion, sex, handicap, familial status, national origin, or any other protected characteristic.

8. Acceptable use

Do not use our site or messaging to break the law, infringe anyone's rights, send unsolicited advertising, attempt to gain unauthorized access to our systems, or interfere with the operation of our services.

9. Intellectual property

The content, branding, and software on this site are owned by Casa Simple or its licensors and are protected by intellectual property law. You may not copy, reproduce, or create derivative works from them without our written permission.

10. Third-party services and links

Our site links to and integrates third-party services. We do not control those services and are not responsible for their content, availability, or privacy practices.

11. Disclaimers

Our site and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any information on it is accurate or complete.

12. Limitation of liability

To the maximum extent permitted by law, Casa Simple and its officers, agents, and employees are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the site or services. Our total liability for any claim relating to the site or services will not exceed one hundred dollars ($100).

13. Indemnification

You agree to indemnify and hold Casa Simple harmless from claims, losses, and expenses, including reasonable attorney fees, arising from your misuse of the site or services or your violation of these terms.

14. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

We may update these terms from time to time. The effective date at the top of this page reflects the most recent version. Continuing to use the site after a change means you accept the updated terms.
